'ELLA program Educator Support' and 'ELLA F–2 Schools Educator Support' Facebook Group Terms of Use

ELLA means Early Learning Languages Australia.

ESA means Education Services Australia Limited.

ELLA program Educator Support Facebook Group means the ELLA program educator and teacher community of practice accessed via Facebook groups (https://www.facebook.com/groups/1556177034623946).

ELLA F–2 Schools Educator Support Facebook Group means the ELLA F–2 schools educator and teacher community of practice accessed via Facebook groups (https://www.facebook.com/groups/884006752296390).

You means an educator or teacher whose preschool or school is participating in the ELLA program or ELLA F–2 schools.

  1. You must either own or have rights to use the content that you post to the ELLA program Educator Support Facebook Group or ELLA F–2 Schools Educator Support Facebook Group. You must not post an image depicting a child unless You have obtained written parental/guardian consent to do so, prior to posting the image.
  2. Your posts will be made available to:
    • educators and teachers whose preschools and schools are participating in the ELLA program and ELLA F–2 schools, for educational use; and
    • ESA and the Australian Government for purposes related to the ELLA program and ELLA F–2 schools.
  3. The content You post must not:
    • be illegal, obscene, defamatory or threatening;
    • infringe intellectual property rights, breach any privacy law or other law;
    • be injurious or objectionable;
    • promote any product, cause, or political candidate or party;
    • be misleading or false;
    • contain viruses or other computer files, or programs designed to interrupt, limit or destroy the functions of other computer software or hardware; or
    • interfere with any other user's contribution to or use and enjoyment of the ELLA program Educator Support or ELLA F–2 Schools Educator Support Facebook Group.
  4. You warrant and represent that:
    • You either own or have rights to use the content in Your post, including all the rights necessary for You to post to the ELLA program Educator Support or ELLA F–2 Schools Educator Support Facebook Group; and
    • the content You post does not violate these Terms of Use.
  1. You will indemnify and hold ESA and the harmless for all claims resulting from Your posts.
  2. ESA does not have any obligation to monitor, filter, censor, edit or regulate content posted to the ELLA program Educator Support or ELLA F–2 Schools Educator Support Facebook Group. However, ESA  reserves the right to edit or remove Your post without prior notice.
  3. You are responsible for all posts made, and the consequences of posting, to the ELLA program Educator Support or ELLA F–2 Schools Educator Support Facebook Group. ESA is not responsible or liable for Your posts to the ELLA program Educator Support or ELLA F–2 Schools Educator Support Facebook Group.
  4. ESA will not be liable for any errors or omissions or loss or damage incurred as a result of use of any content posted on the ELLA program Educator Support or ELLA F–2 Schools Educator Support Facebook Group. You must evaluate and assume all risks associated with the use of any post, including any reliance on the accuracy, completeness, or usefulness of such post.
  5. If you do not comply with these Terms of Use, depending on the nature of your non-compliance, ESA may:
    • request that you cease your non-compliance and, if you fail to do so, terminate Your access to the ELLA program Educator Support or ELLA F–2 Schools Educator Support Facebook Group;
    • immediately terminate your access to the ELLA program Educator Support or ELLA F–2 Schools Educator Support Facebook Group; and/or
    • take any other action that ESA may deem appropriate in the circumstances.

These Terms of Use were last updated on 17 January 2022.

These Terms of Use apply to you in addition to the Facebook Community Standards (https://www.facebook.com/communitystandards) and the Facebook Terms (https://www.facebook.com/terms). To the extent that there is any conflict between these Terms of Use and the Facebook Community Standards and/or the Facebook Terms, the Facebook Community Standards and Facebook Terms take priority but only to the extent of the conflict.
